The Scottish Ministers in exercise of the powers conferred by sections 7(2)(a) and 14(3) of the Regulation of Care (Scotland) Act 2001[1] and of all other powers enabling them in that behalf, hereby make the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Regulation of Care (Applications and Provision of Advice) (Scotland) Amendment Order 2003 and shall come into force on 1st April 2003. (2) In this Order "the principal Order" means the Regulation of Care (Applications and Provision of Advice) (Scotland) Order 2002[2]. Amendment of the principal Order 2. - (1) For article 2 of the principal Order substitute-
(2) Where an application is for registration of a housing support service, paragraphs 5, 31, 32 and 33 of the Schedule shall not apply. (3) Where an application is for registration of a child care agency, paragraphs 12, 31, 32 and 33 of the Schedule shall not apply. (4) Where an application is for registration of a limited registration service, paragraphs 5, 7, 9, 12, 15, 28, 29, 31, 32 and 33 shall not apply.".
(2) In each of the following provisions of the principal Order after "care service" insert "or limited registration service":-
(b) article 4(1); (c) article 5(1); and (d) paragraphs 4 (in both places where there is a reference to a care service), 8, 11, 13, 17, 20(a)(i), 21(a), 23, 26 (in both places where there is a reference to a care service) and 27 of the Schedule.
(This note is not part of the Order) This Order amends the Regulation of Care (Applications and Provisions of Advice) (Scotland) Order 2002 so that it specifies the information which is to be provided by a person who makes an application for registration of a housing support service, a child care agency or a limited registration service.
